Notwithstanding anything in TOS or any other agreement between you and us, you shall without raising any objections or hindrance, allow us to communicate with you through any electronic or physical means that includes without limitation Email, SMS, Alert Window, Telephone, Post etc, if we in our sole discretion determine that there is a special circumstance related to T7Website or your use of T7Website that demands us to establish such communication with you. 

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically, either on T7Website or locally on your computing resource, satisfy any legal requirement that such communications be in writing.

By viewing or using T7Website or availing of any service, or using communication features on the T7Website, you may be exposed to content posted by other users which you may find offensive, objectionable or indecent. You shall bring such content posted by other users to our notice. We reserve the right to act upon the same as we may deem fit. The decision taken by us on this regard shall be final and binding on you.

You shall consult your legal counsel and review TOS before agreeing or accepting it.

User Account Creation, Validation & Operation

To use any of our product and most of our services, you will need to undergo a registration process and take a membership with T7Website. During the registration process, you will be required to choose a login name and a password in addition to providing some other information which may not be mandatory. Additionally, you may be required to give further personal information for your user account verification / validation. Any information provided by you to us shall be complete and true to the best of your knowledge and you shall update this information and keep it current. Information that is used by us to establish contact with you like your phone number, Email address, physical communication address etc shall be active i.e in case of phone number it should be regularly used by you and in which you are available to receive calls any day or time of the year, in case of Email address it should be visited at least once every two days, and in case of physical communication address it should be of a place where you live currently. We are not obliged to cross check or verify information provided by you and we shall not take any responsibility for any outcome or consequence as a result of you providing incorrect information or concealing any relevant information from us. You acknowledge that we may, at any time, attempt to verify the correctness of the information provided by you and in the process may require additional documentary proof from you. These attempts may be made via phone calls or Emails. In the event that we are not able to get in touch with you the first time around, we shall make four additional attempts to establish contact with you at a 1 week frequency. If contact couldn’t be established still or if any documentary proof asked for is not submitted with in the time frame mentioned in the previous established contact we reserve the right to temporarily or permanently suspend your membership in T7Website.

You understand that it is your responsibility to protect the information you provide on T7Website including but not limited to your Username, Password, Email address, Contact Details and Mobile number and other personal information if any. We shall not ask for your user account information other than at the time of logging in to your membership account in T7Website or at the time of authorizing your access to any purchased software service (through a login window integrated in to the software application associated with corresponding service, once every time the application is executed). At no other time should you provide your user account information to any user logged in on T7Website or elsewhere. You shall also not share your user account details and then allow any other person to enjoy the benefits provided to you as a member of T7Website like without limitation, using any of our product / service.

User Restrictions

You shall not add unauthorized components, create or use cheats, exploits, bots, hacks or any other third-party software to alter or modify any T7Website content which shall include but not limited to any files that are part of T7Website or use any third-party software that intercepts, mines or otherwise collects information from or through T7Website or through any services. You shall also not host, intercept, emulate or redirect proprietary communication protocols, if any, used by T7Website regardless of the method used, including protocol emulation, reverse engineering etc. Any such attempt that you do on your own or with external assistance is strictly prohibited.

You shall not upload, distribute or publish through T7Website, any content which may contain viruses or computer contaminants (as defined in The Information Technology Act 2000 or such other laws in force in India at the relevant time) which may interrupt, destroy, limit the functionality or disrupt any software, hardware or other equipment belonging to us or that aids in providing services offered by us. You shall not disseminate or upload programs or software whether it is harmful to T7Website or not. Additionally, you shall not impersonate another person or user, attempt to get a password, other user account information, or other private information from a user, or harvest Email addresses or other information. 

You shall not post any material or comment, on any media available for public access, which in our sole discretion, is defamatory or detrimental to our business interests, notwithstanding the fact that such media is not owned or controlled by us. In addition to any other action that we may take pursuant to the provision hereof, we reserve the right to remove any and all material or comments posted by you and restrict your access to any media available for public access that is either controlled or moderated by us, when in our sole opinion, any such material or comments posted by you is defamatory or detrimental to our business interests.

You shall not create any links to T7Website from another website or document without our prior written consent, unless the link created is in sync with Section T7Website Access License of this TOS.

You shall not under any condition send SPAM Emails or any other form of unsolicited communication for obtaining registrations or membership in T7Website to benefit from any of our promotional programs or for any other purpose.

Your registration on T7Website is restricted to a single user account which will be used by you to avail for yourselves the services provided on T7Website. You are prohibited from creating or operating multiple membership accounts in T7Website.

You shall not access or attempt to access any service provided by T7Website through someone else’s user account.

You shall not use or attempt to use any other person’s credit card(s), debit cards, net-banking usernames, passwords, authorization codes, prepaid cash cards, mobile phones etc for completing financial transactions originating against a purchase request made by you in T7Website.

You shall not purchase, sell, trade, rent, lease, license, grant a security interest in, or transfer your user account, content, referral / discount points or any other attributes appearing in, originating from or associated with T7Website.

You shall use any product or service provided to you through T7Website only for your personal use and not for commercial purposes including but not limited to use in cyber cafes, trading kiosks,  shared computer network like LANs,  unauthorized servers etc.

You shall not create a login name or password or upload, distribute, transmit, publish or post content through or on T7Website or through any service or facility including any messaging facility or social plugins provided by T7Website which

is libellous, defamatory, obscene, intimidating, invasive of privacy, abusive, illegal, harassing;

contains expressions of hatred, hurting religious sentiments, racial discrimination or pornography;
is otherwise objectionable or undesirable (whether or not unlawful);
would constitute incitement to commit a criminal offence;
violate the rights of any person;
is aimed at soliciting donations or other form of help;
violates the intellectual property of any person;
disparage us or any of our subsidiaries, affiliates, licensors, associates, partners, sponsors, products, services, or websites in any manner whatsoever;
promotes a competing service or product; or
violate any law.

If we notice and determine that the login name created by you is indecent, objectionable, offensive or otherwise undesirable, an Email notification about the same shall be sent to you and you shall promptly provide an alternate login name to replace the existing login name. If you fail to provide an alternate name, we reserve the right to either temporarily / permanently suspend your user account and restore your user account only after a different acceptable login name has been provided by you.

You shall not frame T7Website. You may not impose editorial comments, commercial material or any information on T7Website; remove, obliterate or obstruct any proprietary notices or labels.

You shall agree and accept the LTC (shown to you as a webpage by T7Website before you proceed to place order) before placing order for the corresponding product / service.

All orders shall be placed online through T7Website. Having placed an order, you have ensured that all the information provided to T7Website and / or our Service Provides in conjunction with your order is true, accurate and current. Also you are the individual identified as the intended recipient of the product / service being ordered.

All payment transactions arising against placed orders are processed by third party payment gateway service provider Razorpay Software Private Limited or any other such third party payment gateway service provider selected by us for the purpose. We shall not be held responsible for delays or denials at their end and processing of payments will be solely in terms of their policies and procedures without any responsibility or risk at our end.

All orders placed are considered to have been executed and successfully completed at such time as they are received and accepted by T7Website or our third party payment gateway service provider Razorpay Software Private Limited or any other such third party payment gateway service provider selected by us for the purpose. Once your order has been successfully completed, it shall not be modified or cancelled in any way, for any reason.

You will make no effort to withhold payment for your order or to subsequently dispute payment for your order, subject to the laws of the jurisdiction where you reside. If we do not receive complete payment for your order due to a dispute, insufficient funds or any other cause, we shall have recourse to seek payment in any manner we see fit, subject to the laws of the jurisdiction where you reside. Further, in this eventuality, you agree to pay, in addition to the total value of your order, any reasonable cost of collection required to obtain payment for your order by us or our agents or representatives.

We shall have the right to cancel any placed order or corresponding transaction whether completed successfully or not, at any point of time, solely at our discretion. Under such a scenario if we receive a payment from you then that specific transaction shall be reversed and money shall be credited back to your payment instrument with in a reasonable time line fixed solely by us.

All products and services shall be delivered online by providing you with clickable links (in Email and your user account in T7Website) to download the necessary application files (if need be). You shall ensure that you have sufficient expertise to effect the download using such links provided to you. Responsibility for successfully acquiring downloadable files for purchased product / service is wholly yours and your inability to download the said files does not constitute sufficient grounds for the cancellation of corresponding order or for dispute of the charges for said order or any product / service therein.

By placing an order through T7Website, you permit us to communicate with you through electronic media such as Email or SMS for the purpose of fulfilling and subsequently servicing your order. Electronic communication is not infallible, and that if because of such unfortunate errors in electronic communication your orders are not fulfilled or serviced, our sole responsibility shall be to retransmit electronically, content in the aforementioned communication to you. Non-delivery of your order does not constitute sufficient grounds for cancellation of corresponding order, or for dispute of the charges for said order or any products / services therein. In the event that your order is not delivered within three days, you shall contact us and arrange for a replacement order, the medium of the replacement order to be identical to the medium of the original order. Our sole responsibility under such an event shall be to effect a replacement of your order.

In the event that your order is found to have been undelivered due to an error in the information provided by you to us for the purpose of delivering your order, you shall compensate us for the cost of a replacement order, including but not limited to packaging costs, media costs or labor costs, if so requested by us.

We may initiate and run a Referral System, to encourage you in bringing new customers on an ongoing basis. This program shall be run as per the Referral System Terms & Conditions which you shall accept and abide by, if you want to be part of and reap benefits from our Referral System. We shall have the right to deny you participation in our Referral System, if you do not accept the said Terms and Conditions. We shall also have the right of terminating your participation in our Referral System, any time we detect a violation of the said Terms and Conditions (after a previous acceptance of said Terms and Conditions), with or without granting you the rights to enjoy the unused benefits accrued until the day of such termination.

We may declare discounts or other incentives from time to time to reward your loyalty or to bring more customers, and all such offers shall be governed by the terms and conditions communicated to you at the time of initiating such offers.
We may discontinue or alter any of our promotional programs including but not limited to the above mentioned Referral System or Loyalty Rewards at our will without any liability towards you in any manner whatsoever.

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; 
A description of the copyrighted work that you claim has been infringed upon;
A description of where the material that you claim is infringing is located on T7Website;
Your address, telephone number, and Email address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

If you knowingly misrepresent that the content on T7Website has infringed on your intellectual property rights, then you agree to our right to recover any cost incurred by us or by any other copyright owner or his licensee while processing your compliant that includes without limitation court costs and attorney fees.

Geographical Concerns / Restrictions

Without prejudice to the generality of the foregoing, some LTC agreements may impose geographic restrictions on access / use of corresponding products / services and you shall not under any circumstance place orders or access / use those products / services outside the specified geographical zones in the LTC. We may take any action that we may deem fit if we find a violation of such LTC specific geographic restriction including but not limited to rejection of refund request for any orders placed, denial of service, termination of your user account etc.

T7Website Access License 

We grant you a limited, revocable, and nonexclusive license

to access and make personal use of T7Website; and 

to create a hyperlink to T7Website’s home page as long as the link does not portray us (in our sole discretion) or our products / services or our distributors or our service providers in a false, misleading, derogatory, or otherwise offensive manner.

We do not grant you any right to use T7Website in any other manner, that includes without limitation

downloading (other than page caching), modifying, reproducing, copying, duplicating T7Website or any portion of it;
any collection and use of any product listings, descriptions, or prices;
any derivative use of T7Website or its contents;
any downloading or copying of account information for the benefit of another merchant;
any use of data mining, robots, or similar data gathering and extraction tools;
framing or utilizing framing techniques to enclose any of our trademark, logo, or other proprietary information (including images, text, page layout, or form);
using meta tags or any other "hidden text" utilizing our name or trademarks;
using any of our logo or other proprietary graphic or trademark as part of a link; or any sale, resale, visit or other modes of exploitation of T7Website, in part of whole, for commercial purposes;

Support

Support shall be provided only as per our Support Policy. Support shall be free of cost, under most cases. However if processing of a support request made by you seems like a costly affair to us, we may specifically request you to pay applicable support charges (decided on a case to case basis by us) prior to processing of such a support request from you.

Disclaimer, Indemnity & Limitation of Liability

In addition to any specific references to Disclaimers, Indemnity and / or  Limitation of Liability in TOS or any other agreement between you and us, we propose the following clauses of Disclaimer, Indemnity and Limitation of Liability.

Trading in Stock Exchanges is a risky activity and while we may promote trading as a viable income generating activity and sell products / services related closely to trading, we don’t in any way guarantee that past performance will be replicated in future or that you will create wealth using any or all content or products / services made available through T7Website. Responsibility for any of your actions in Stock Exchanges and any consequences arising because of those actions undertaken by you, which shall include but not limited to buying and selling of financial instruments is completely yours and we disclaim liability to you for any loss or damage including without limitation, financial loss or other direct, indirect, consequential or incidental damages or loss arising to you, out of such actions undertaken by you.

All content present on or otherwise made available to you through T7Website, which shall include but not limited to text, images, files, video clips, products, services etc, are provided on an “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing, about the completeness, accuracy, reliability, suitability or availability of the content on T7Website for any purpose. Any reliance you place on such content is therefore strictly at your own risk. We disclaim liability to you for any loss or damage including without limitation financial loss or other direct, indirect or consequential loss or damage, arising to you, from or in connection with the use of any T7Website content.

We don’t warrant that any content, which shall include but not limited to text, images, files, video clips, products, services included on or otherwise made available to you through T7Website; its servers; or electronic communication sent from T7Website are free of viruses or other harmful components. We disclaim liability to you for any loss or damage including without limitation financial loss or other direct, indirect, consequential or incidental damages or loss arising to you out of the presence of such viruses or other harmful components.

Every effort is made to keep T7Website up and running smoothly. However, we don’t guarantee that T7Website or any of the products / services made available to you through T7Website will be constantly available or available at all. We disclaim any liability to you for such unavailability due to any reason including but not limited to technical issues, legal issues, financial issues, computer viruses or other contaminants, terrorism, war, natural disasters, civil disturbances etc.

We disclaim liability to you for any loss or damage including without limitation, financial or other direct, indirect or consequential loss or damage, arising to you, from a change in mode of operation (including but not limited to disabling of features or functionality advertised earlier while you made your purchase) of our products / services due to any reason that includes without limitation technical or legal issues.

We disclaim liability for any loss or damage including without limitation, financial loss or other direct, indirect, consequential or incidental damages or loss arising to you,

because of  non-delivery of Renewal Alerts, Marketing Alerts and / or Critical Alerts due to preferences set by you, inside your user account in T7Website for delivery of such alerts.

because of failure of any mode of electronic communication (including but not limited to Email, SMS, Alert Window etc) that we may rely on to communicate with you or that you may rely on to communicate with us.

We disclaim liability for any loss or damage including without limitation, financial loss or other direct, indirect or consequential loss or damage arising to you because of disruption / denial of any of your payment transactions initiated from T7Website due to any reason whatsoever, which shall include but not limited to, lack of authorization for any transaction(s), exceeding of the preset limit mutually agreed by you and between your "Bank(s)", any payment issues arising out of the transaction etc.

We disclaim any liability to you for acts or omissions (includes without limitation any act that lead to your privacy violation) of our service providers or otherwise failure of internet services used for providing and accessing the products or services made available to you through T7Website.

We disclaim any liability to you for violation of your intellectual property with respect to third party content or user content posted on T7Website. Intellectual property rights in any content not belonging to us belong to the respective owners and any claims related to such content must be directly addressed to the respective owners.

Though we do not compromise on safety of data disclosed by you and follow industry standard practices to ensure the same, external third parties may illegally (highly unlikely but not impossible) intercept information flow between you and T7Website or between T7Website and our service providers or hack into or hijack T7Website and access your personal information. Also if you do not give sufficient care in protecting membership account User Name and Password your personal information may be subjected to unauthorized access / use. Such acts are beyond our control and hence under such circumstances we disclaim liability to you for any violation of your privacy.

We shall not be liable under any circumstance (including, without limitation, in contract, negligence or other tort) for any injury, loss, claim, loss of data, loss of income, loss of profit or loss of opportunity, loss of or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with your access to, or use of, or inability to access or use, the products distributed through and Services rendered by T7Website. You shall indemnify us and / or Distributor(s) and / or Service Provider(s) (to the extent of all benefits and awards, cost of litigation, disbursements and attorney fees that we may incur in connection therewith including any direct, indirect or consequential losses, any loss of profit and loss of reputation) against any claims in respect of any such matter.

To the extent permitted by law, and without prejudice to the generality of the foregoing you hereby agree to indemnify, save and hold harmless and defend us and / or Distributor(s) and / or Service Provider(s) (to the extent of all benefits and awards, cost of litigation, disbursements and attorney fees that we may incur in connection therewith including any direct, indirect or consequential losses, any loss of profit and loss of reputation) from any claims, actions, suits, taxes, damages, injuries, causes of action, penalties, interest, demands, expenses and/or awards

asserted or brought against it by any person in connection with infringement of their intellectual property rights by your publication of any content on T7Website; 

arising out of defamatory, offensive or illegal conduct from your side or for anything that turns out to be misleading, inaccurate, defamatory, threatening, obscene or otherwise illegal originating from your side;

arising out of use, abuse or misuse of your user account or any feature of T7Website in any manner whatsoever, which includes but not limited  to unauthorized access of your user account by any other person using your username or password;

arising out of any disconnections, technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data or communication lines failure, distributed denial of service attacks, viruses or any other adverse technological occurrences arising in connection with your access to or use of T7Website.

arising out of defamatory, undesirable or illegal conduct of any other user of T7Website towards you;

arising out of any loss incurred in transmitting information from or to us via internet or by other connecting media;

arising out of non delivery of your orders;

arising out of your reliance on T7Website content;

arising out of any delay or failure on our part to intimate you where we may have concerns about your activities;

arising out of your activities / transactions on third party websites accessed through links or advertisements posted in T7Website; and

arising out of your violation of TOS in any manner whatsoever.

Notwithstanding anything to the contrary contained in the Terms or elsewhere, our maximum aggregate liability for all your claims under this agreement, in all circumstances, shall be limited to Indian Rupees One Hundred only (INR. 100/-).

User Account Suspension

We may suspend or otherwise put restrictions (to any extend as deemed appropriate by us) on your access to T7Website or any of the products / services offered through T7Website under the following circumstances

Suspected violation of TOC or other abuse of your user account;

Suspected violation of LTC of any product / service

Suspected breach of security of your user account; or

If there have been charge-backs on your user account.

Our decision to effect such suspension or restriction shall be final and binding on you.

Breach & Consequences

In the event of breach of TOC being evidenced from our investigation or if there is reasonable belief, in our sole discretion, that your continued access to T7Website is detrimental to our interest, other users of T7Website or the general public; we may in our sole discretion take any or all of the following actions

Permanently suspend your user account on T7Website;

Demand damages for breach and take appropriate civil action to recover such damages; and/or

Initiate prosecution for violations that amount to offences in law.

Additionally, in the event of committing material breach hereof, we reserve the right to bar you from future registration on T7Website.

Our decision on the action to be taken as a consequence of breach shall be final and binding on you. Also any action taken by us shall be without prejudice to our other rights and remedies available in law or equity.

Term & Termination

Term of TOS shall begin as of the day and time of your acceptance of TOS and shall continue in effect till it is terminated

automatically after the expiry of the Advance Change Notification period, if you rejected any modifications / alterations to TOS effected by us with in the Advance Change Notification period, provided your decision to reject the modified TOS is not withdrawn by you within that Advance Change Notification period (by sending us an Email to support@t7wealth.com, intimating us about your decision to withdraw your rejection request).

automatically after the expiry of Advance Termination Notification Period for a TOS Termination Notice send to you by us, provided our decision to terminate TOS with you is not withdrawn by us within that Advance Termination Notification Period (by sending you an Email to your registered Email ID with us, intimating you about our decision to withdraw the TOS Termination Notice served earlier).

automatically after the expiry of Advance Termination Notification Period for a TOS Termination Notice send to us by you, provided your decision to terminate TOS with us is not withdrawn by you within that Advance Termination Notification Period (by sending an Email to support@t7wealth.com intimating us about your decision to withdraw the TOS Termination Notice served earlier). 

Upon termination of TOS your license rights granted under Section T7Website Access License of TOS shall stand terminated. But any other rights or obligations accrued by you or us prior to the effective date of termination of TOS shall survive the termination of TOS.

If TOS is terminated, then we reserve the right to permanently suspend your user account in T7Website and / or to deny you future access to T7Website or any of the products / services distributed through T7Website, without granting any compensation whatsoever that includes but not limited to full or pro rata refund of your subscription charges against any past purchase orders placed by you through T7Website (even if corresponding subscription period has not expired). 

Any future acceptance of a new TOS either through T7Website pop up interface or through the use of T7Website in any form whatsoever (that includes without limitation surfing / browsing T7Website, creating a membership account in T7Website, placing an order for any product or service offered through T7Website, downloading and using any materials from T7Website, participating in any of the promotional schemes published on T7Website etc) shall not be enough to over rule the consequences /  outcome of TOS termination unless and until we in our sole discretion decide to over rule such past consequences / outcome.

If any part/section/clause of TOS is determined to be invalid or unenforceable, then that invalid or unenforceable part/section/clause shall be deemed superseded by a valid, enforceable part/section/clause that most closely matches the intent of the original part/section/clause, and the remainder of TOS shall continue in effect.

TOS shall be interpreted in accordance with the laws of India.

Any dispute, controversy or claim arising out of TOS shall be subject to the exclusive jurisdiction of the civil courts of Thiruvananthapuram, Kerala, India.

If you have a complaint,

it should be notified to us as soon as possible, after circumstances arise, that cause you to have a complaint.

you accept that any complaints and disputes are and remain confidential both whilst a resolution is sought and afterwards. You agree that you shall not disclose the existence, nature or any detail of any complaint or dispute to any third party.

we shall make efforts to resolve complaints within reasonable time and our decision on complaints shall be final and binding on you.
